2. Website Information
We make reasonable efforts to ensure that information presented on our website is accurate and current.
Tour descriptions, photographs, itineraries, schedules, travel times, attraction availability, inclusions, and other information are provided for general guidance. They may change because of weather, traffic, road conditions, public events, government restrictions, attraction closures, safety concerns, operational requirements, or circumstances outside our reasonable control.
Submitting an inquiry through the website does not by itself create or confirm a reservation.
3. Tour Inquiries and Quotations
When requesting information or a quotation, you agree to provide accurate and reasonably complete information, including:
- Your name and contact information
- Number of travelers
- Preferred date
- Requested tour or service
- Pickup location
- Relevant accessibility or mobility requirements
- Other information reasonably necessary to arrange the service
A quotation may be based on the information available at the time it is prepared. Prices or availability may change before a reservation is confirmed.
Unless stated otherwise in writing, quotations are not guaranteed indefinitely and do not reserve a vehicle, guide, ticket, attraction, or tour date.
4. Booking Confirmation
A booking is confirmed only after Quito Ecuador Tours has:
- Confirmed availability in writing;
- Provided the applicable price and booking details;
- Received any required payment or deposit; and
- Sent written confirmation by email, WhatsApp, or another agreed communication method.
A contact-form submission, message, verbal discussion, or quotation alone does not constitute a confirmed reservation.
Customers should review the confirmation carefully and immediately notify us of any incorrect names, dates, locations, guest counts, or other details.
5. Prices
Tour and transportation prices may depend on factors including:
- Date and availability
- Number of guests
- Pickup and drop-off locations
- Tour duration
- Vehicle requirements
- Guide requirements
- Attraction or admission costs
- Requested customizations
- Seasonal or operational conditions
The price and included services for a specific booking will be provided before payment or confirmation.
Unless expressly stated otherwise, prices do not include personal purchases, meals, gratuities, optional activities, travel insurance, immigration expenses, medical expenses, or services not listed in the booking confirmation.
6. Payments
Available payment methods and any required deposit or payment schedule will be communicated before the booking is confirmed.
Customers are responsible for providing accurate payment information and using a payment method they are legally authorized to use.
A reservation may remain unconfirmed until the required payment has been successfully received and verified.
Quito Ecuador Tours may cancel or decline a transaction that appears unauthorized, fraudulent, incomplete, or inconsistent with the agreed booking details.
7. Cancellations and Refunds
Cancellation and refund conditions may vary depending on the tour, date, transportation provider, attraction tickets, guide reservation, group size, and other services included in the booking.
The cancellation and refund conditions applicable to your reservation will be disclosed in your quotation, payment request, or booking confirmation before payment. Those booking-specific conditions form part of these Terms and control in the event of a conflict.
Certain third-party tickets, admissions, reservations, transportation services, or prepaid expenses may be non-refundable once purchased or confirmed.
Approved refunds, when applicable, may exclude:
- Non-refundable third-party charges
- Payment-processing charges that are not returned to us
- Bank or currency-conversion fees
- Services already provided
- Expenses reasonably incurred specifically for the booking
Refund processing times may depend on the bank, card issuer, payment provider, or other financial institution involved.
Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded.
8. Changes Requested by the Customer
Requests to change a date, time, pickup location, itinerary, guest count, vehicle, or other booking detail are subject to availability.
A requested change may result in:
- A revised price
- Additional transportation costs
- Different availability
- Changes to the itinerary
- A new payment requirement
- Application of the original cancellation terms
A requested change is not effective until Quito Ecuador Tours confirms it in writing.
9. Changes or Cancellations by Quito Ecuador Tours
We may reasonably modify, postpone, substitute, shorten, reroute, or cancel a service when necessary because of:
- Unsafe weather
- Road closures or traffic disruptions
- Natural disasters
- Civil disturbances or public demonstrations
- Government orders or restrictions
- Attraction closures
- Mechanical or transportation problems
- Guide or driver emergencies
- Illness
- Security concerns
- Events outside our reasonable control
When practical, we may offer a reasonable alternative, rescheduled date, substitute itinerary, credit, or refund based on the circumstances and expenses already incurred.
Customer safety and legal compliance take priority over completing an itinerary exactly as originally described.
10. Pickup and Punctuality
Customers are responsible for providing an accurate pickup location and being ready at the confirmed time.
Traffic, restricted access, road conditions, hotel rules, airport procedures, and similar circumstances may affect pickup times.
Customers should keep their telephone or WhatsApp service available around the scheduled pickup time.
A significant customer delay may shorten the tour, affect the itinerary, result in missed reservations, or be treated as a late cancellation or no-show when the service can no longer reasonably be provided.
11. Customer Responsibilities
Customers agree to:
- Follow reasonable safety instructions
- Treat guides, drivers, other guests, local residents, property, and animals respectfully
- Comply with applicable laws and attraction rules
- Avoid conduct that is dangerous, abusive, threatening, discriminatory, disruptive, or unlawful
- Wear appropriate clothing and footwear for the activity
- Safeguard their personal belongings
- Inform us in advance of relevant accessibility needs
- Avoid participating while impaired by alcohol, illegal drugs, or other substances
- Provide truthful booking and contact information
Quito Ecuador Tours may refuse or discontinue service when a participant’s behavior creates a safety risk, seriously disrupts the experience, violates applicable law, or threatens another person or property.
A customer removed from a tour for serious misconduct may not be entitled to a refund for unused services.
12. Health, Fitness, Altitude, and Accessibility
Certain tours may involve walking, stairs, uneven surfaces, altitude, changing weather, extended driving, outdoor conditions, or physical activity.
Customers are responsible for deciding whether an activity is suitable for their health, abilities, and circumstances. Customers should consult a qualified medical professional when uncertain about their ability to participate.
Please tell us before booking about mobility limitations, accessibility requirements, allergies, or other circumstances that may affect participation. We will make reasonable efforts to explain available options, but not every destination, vehicle, attraction, or route may be fully accessible.
Quito Ecuador Tours does not provide medical advice.
13. Children and Minors
A parent, legal guardian, or authorized responsible adult must make arrangements for a traveler who is a minor.
Children must remain under the supervision of their accompanying adult.
The accompanying adult is responsible for providing accurate information concerning the child’s age and any required transportation, seating, documentation, health, or accessibility needs.
14. Travel Documents and Entry Requirements
Customers are responsible for obtaining and carrying valid passports, visas, identification, permits, vaccination records, entry documents, or other documentation required for their travel.
Quito Ecuador Tours is not responsible for a customer being refused transportation, admission, or entry because of missing, expired, incorrect, or insufficient documentation.
15. Personal Belongings
Customers are responsible for safeguarding luggage, phones, cameras, passports, money, jewelry, and other belongings.
Please inspect the vehicle and surrounding area before leaving. Report a lost item promptly, and we will make reasonable efforts to help locate it.
Quito Ecuador Tours is not responsible for loss, theft, or damage except to the extent responsibility cannot legally be excluded.
16. Third-Party Services
Some tours or packages may involve independent guides, drivers, vehicle operators, attractions, restaurants, hotels, activity operators, ticket providers, or other third parties.
Those providers may have their own operating rules, schedules, waivers, cancellation policies, safety requirements, and terms.
Quito Ecuador Tours will use reasonable care when arranging third-party services but does not control every act, omission, closure, delay, or operational decision of an independent provider.
17. Assumption of Ordinary Travel Risks
Travel and outdoor activities involve ordinary risks, including changing weather, altitude, traffic, uneven terrain, crowded public areas, road conditions, delays, and conduct by third parties.
By participating, customers acknowledge the ordinary risks reasonably associated with the selected activity.
Nothing in these Terms excludes responsibility that cannot legally be excluded or limited.
18. Photographs and Media
Customers may take photographs and videos for lawful personal use unless prohibited by an attraction, property owner, guide, local rule, or applicable law.
Quito Ecuador Tours will not use an identifiable customer’s photograph or video for promotional purposes without permission where consent is required.
Permission may be withdrawn for future use by contacting us, although withdrawal may not affect material already lawfully published or distributed.
19. Privacy
Personal information submitted through the website, email, WhatsApp, social media, telephone, booking process, or another communication channel is handled according to our Privacy Policy.
Customers should not submit full payment-card numbers, passwords, or unnecessary confidential information through the public contact form.
20. Website Use
You may use this website for lawful personal and travel-planning purposes.
You may not:
- Interfere with the website’s operation or security
- Attempt unauthorized access
- Submit fraudulent or misleading information
- Introduce malicious code
- Scrape or reproduce substantial website content without authorization
- Use the website to violate another person’s rights
- Misrepresent an affiliation with Quito Ecuador Tours
We may restrict access when reasonably necessary to protect the website, customers, or business.
21. Intellectual Property
The Quito Ecuador Tours name, branding, website design, written content, original images, graphics, videos, itineraries, and other original materials are owned by or licensed to Quito Ecuador Tours unless otherwise indicated.
No ownership rights are transferred by allowing access to the website.
Content may not be copied, republished, sold, modified, or commercially distributed without prior written permission, except where allowed by applicable law.
22. Disclaimer of Warranties
We make reasonable efforts to provide accurate website information and reliable services.
However, the website is provided on an “as available” basis. We do not guarantee uninterrupted access, error-free operation, specific weather, uninterrupted attraction access, or a particular subjective travel experience.
Any limitation in this section applies only to the extent permitted by applicable law.
23. Limitation of Liability
To the extent permitted by applicable law, Quito Ecuador Tours will not be responsible for indirect, incidental, special, or consequential losses resulting from events outside our reasonable control.
Where liability may legally be limited, our total liability relating to a particular booking will not exceed the amount paid directly to Quito Ecuador Tours for the affected service.
These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.
24. Force Majeure
Quito Ecuador Tours will not be considered in breach of these Terms when performance is prevented or materially affected by events beyond reasonable control, including severe weather, earthquakes, volcanic activity, floods, fires, epidemics, government restrictions, transportation shutdowns, strikes, civil disturbances, road closures, or similar events.
We will make reasonable efforts to communicate material changes and identify practical alternatives when possible.
25. Complaints and Problem Resolution
Please report a problem as soon as reasonably possible so that we have an opportunity to address it.
Concerns may be submitted to:
Include your name, booking date, reservation details, and a clear description of the issue.
We will make reasonable efforts to review the matter and respond fairly.
26. Governing Law
These Terms are governed by the laws of the Republic of Ecuador, without limiting any mandatory consumer protections that may apply.
The parties should first attempt in good faith to resolve disagreements directly.
27. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the extent legally permitted.
28. No Waiver
A failure to enforce a provision on one occasion does not waive the right to enforce that provision later.
29. Changes to These Terms
We may update these Terms when our services, booking practices, technology, or legal obligations change.
The current version will be posted on this page with its updated revision date. Changes will not retroactively alter a confirmed booking unless agreed or required by law.
